Today, Friday, March 10, 2023, Unternehmen Mitte appealed against the decision to award the «Oberer Rheinweg» site by means of an appeal and around 1,500 additional signatures.
This is for the following, non-conclusive reasons: The winning project uses merely conventional application prose and does not stand up to a realistic feasibility check. In addition, the bidding documents were not properly prepared. In particular, there was a lack of information on how the specified criteria were rated. In addition, not all of the criteria specified in the bidding documents were taken into account in the decision, and new selection criteria not specified in the bidding documents appeared.
The responsible authority, Esther Keller’s Department of Construction, corresponded with the winning project several times during the process. In this context, the authority made explicit recommendations that led to improvements being made to the rival project’s application.

The awarding authority also instructed the winning project to have its waste concept reviewed by the Office for the Environment and Energy (AUE) and to report the results of the AUE’s review. It is striking that these points (waste concept, energy supply) were prioritized so heavily in the end that they were decisive for the result.
In addition, the contract was awarded to a limited liability company that still doesn’t exist in the commercial register. In turn, the authorities are keeping the real authorship secret, i.e. the passages in the application about who is actually behind the application and responsible have been blacked out.
For these reasons, we should be awarded the contract or the bidding process must at least be repeated.
